That’s it.  That is his policy.  I know because I actually watched it.  (truth be told, I have a bad cold and was watching fox news when he came on. Remote was across the room and I just did not have the energy to get up and change the channel)

I remember a bumper sticker in 2008 that read, “Want Socialized Medicine, $3.00 Gas and Gay marriage, Vote Obama.  Well, we got all of that didn’t we.

We need a new bumper sticker.

Want $5.00 Gas, a $20 Trillion Debt and the next world war – Vote for Obama.

A Parent in Oklahoma needs to have the ability to spend what ever money is now spent on their child in Government Schools to obtain a better education.  It can be a private school, a co-op school, a religious school or Home school.  The Parent NEEDS to control where the money goes.

Read the below and just know, this very SAME thing CAN happen in Oklahoma.  Don’t let anyone fool you.

A mother in Hoke County complains her daughter was forced to eat a school lunch because a government inspector determined her home-made lunch did not meet nutrition requirements. In fact, all of the students in the NC Pre-K program classroom at West Hoke Elementary School in Raeford had to accept a school lunch in addition to their lunches brought from home.

NC Pre-K (before this year known as More at Four) is a state-funded education program designed to “enhance school readiness” for four year-olds.

The mother, who doesn’t wish to be identified at this time, says she made her daughter a lunch that contained a turkey and cheese sandwich, a banana, apple juice and potato chips. A state inspector assessing the pre-K program at the school said the girl also needed a vegetable, so the inspector ordered a full school lunch tray for her. While the four-year-old was still allowed to eat her home lunch, the girl was forced to take a helping of chicken nuggets, milk, a fruit and a vegetable to supplement her sack lunch.

The mother says the girl was so intimidated by the inspection process that she was too scared to eat all of her homemade lunch. The girl ate only the chicken nuggets provided to her by the school, so she still didn’t eat a vegetable.

The mother says her daughter doesn’t like vegetables and – like most four year olds – will only eat them at home under close supervision.

In an interview with the Civitas Institute the mother said “I can’t put vegetables in her lunchbox. I’m not a millionaire and I’m not going to put something in there that my daughter doesn’t eat and I’ve done gone round and round with the teacher about that and I’ve told her that. I put fruit in there every day because she is a fruit eater. Vegetables, let me take care of my business at home and at night and that’s when I see she’s eating vegetables. I either have to smash it or tell her if you don’t eat your vegetables you’re going to go to bed.”

The mother added, “It’s just a headache to keep arguing and fighting. I’ve even wrote a note to her teachers and said do not give my daughter anything else unless it comes out of her lunchbox and they are still going against me and putting a milk in front of her every day.

“Friday she came home and said ‘Mom, they give me vegetable soup and a milk,’” said the mother.

“So I went to the cafeteria to make sure she had no fee and it’s not being charged to her account yet,” she continued, ” but what concerned me was that I got a letter from the principal and it says students who do not bring a healthy lunch will be offered the missing portions which may result in a fee from the cafeteria. So if I don’t stay on top of her account on a weekly basis there’s that opportunity that charges could be put on her account and then if I let it go too far then it’s like I’m going to have a big battle.”

The principal of West Hoke Elementary, Jackie Samuels, says none of the children’s parents were asked to pay for the school food. While the parents may not have to pay, it was still an expense for the school to provide the extra food. A phone call to the Hoke County Schools Superintendent to inquire as to how much additional expense this would impose on the school was not returned.

The mother, who lives in Fayetteville, sent a statement to state Rep. G.L. Pridgen (R-Robeson) detailing her complaint. Pridgen says he was shocked to hear it. Pridgen has since learned this is a nationwide practice based on federal guidelines.

An assistant to Pridgen says the girl’s grandmother was also upset and asked, “This isn’t China, is it?”

The government inspector was from the Early Childhood Environment Rating Scale-Revised program at the FPG Child Development Institute at the University of North Carolina at Chapel Hill. The program gives schools a grade based on standards that include USDA meal guidelines enforced by the N.C. Division of Early Childhood Development.

The nutrition standards for pre-K lunch require milk, two servings of fruit or vegetable, bread or grains and a meat or meat alternative. The school didn’t receive a high grade from the January assessment because the home-made lunches didn’t meet those guidelines. The mother points out the only thing on that list her daughter’s home lunch didn’t have was milk, so she doesn’t understand why the girl was given a complete school meal as a supplement.

The mother says her next step is to sit down with the principal and if nothing is done then she plans to go to the school board.

Now Think about this.  Who ARE these people who now own your children.  I did not say, “think they own your children” but they “Do Own your Children”.

Now it has been a while since I had children in public schools.  Back then no school would have dared to do anything like this.  And on a couple of occasions, where one of my children was physically abused by a male teacher, I visited him at the school and “”Explained” to him in very specific, and painful manner” that he was NEVER to do that to my child again.  And he never did.  Today I am sure I would be in jail if I were a parent. If anyone forced my child to eat something  I did not approve, what I did to that other teacher would seem a mild reaction.

Folks, you have to put pressure on your elected State folks to allow YOU to spend the money used to educate your child to be spent by YOU.  YOU ARE responsible for your Children.  And yes, you can pull them out of school and home school, or put them in private or religious schools, you STILL have to pay taxes that you will see no part of for that education.

Of course we should have already recognized that Obama sees himself as a God.  After all, hasn’t he “granted” some special groups and people the “Right” to provide for their own health care?  I mean, the right to own your own body and decided how to take care of it is a gift from God to man, and since OBAMA has decreed that HE is going to “Grant” some a “Right” to NOT participate in his Unconstitutional Health Care Scheme, he must be a GOD. Right?

I guess what this really tells us is that Obama is a legend, and a God, in his own mind.  That this arrogant, egotistical worthless excuse for an American has put himself in a position to “Grant” rights is beyond the pale.]

Hopefully, there are enough people left in this country in November, who are NOT parasites and dependent on sucking at the tax payer’s tit, that we can get him out of Washington.  This guy was a Nightmare of the worse kind.  We need to let him join Jimmy Carter where he will, like Carter, just be a national embarrassment, and no longer a National disaster.

Where did Assad learn such brutality?  Well, from us, where else.

In 1860, seven southern states left the Union.  The People of these states were fed up with the Federal Government abusing them, taxing them and using the proceeds for ‘internal improvement’ almost all of which were in the northern states. They had enough.

Not being too far removed from the time when Thomas Jefferson penned these immortal words:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, — That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness.

The People of the South decided to end the abuse and just go their own way.  They formed, with the consent of the governed, a new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness.

Now, Abraham Lincoln would not let this happen.  He was a Mercantilist (an early from of crony capitalism) and he (Like King George) could NOT afford to let the South leave.  His famous words “what shall I do for my revenue” get to the heart of why he declared war on those states.

Lincoln unleashed total war on the People of these states.  He put some of the most insane people in charge of his armies.  Grant, Sherman, Sheridan were all sociopaths.  There was no atrocity to outrageous for these people to commit.  They shelled cities, with women and children dying by the thousands.  They burned crops and destroyed equipment burned homes and left women and children to survive as best they could with no food, clothes or shelter.  Their troops raped and pillaged white and black women all over the south.  And in many cases murdered them after they were done.

There is NOTHING that Assad or Gaddafi did to THEIR citizens that Lincoln did not do to his.

As a matter of fact, compared to the murders committed by Lincoln, these people are just pikers.  Lincoln was responsible for the deaths of 600,000 men, women and children.  We had to wait for 80 years before any other POWER CRAZED person could murder more.

So, next time you see some cheap politician waxing eloquently about some so called abuse by some cheap dictator, just remember.  We had our own Cheap Dictator who used his power to rob, rape, murder and steal form an entire people.  So “What is the big deal?”

The current Government School system is set up for one reason.  POWER. And with that POWER comes Money.

The people we elect and send to the State House and Washington know this as well.  They know that they can use the millions and billions of dollars that flow into the public coffers to support the education system make lucrative targets for the crooks both in and out of government.

Any honest person in Washington or Oklahoma City knows that if our children are ever to escape the government school nightmare, they have to work to empower parents to choose how their children are educated.  Unfortunately, we seem to have a shortage of honesty in either place.

The allure of Power and the Money that comes with it is just too great for these week men and women to resist.  So our Children are thrown under the “School Bus” in order for these people to continue to betray them and their parents.

In 2009, a NEA lawyer did the unthinkable. He told the truth.  And he admitted that your children are not even on the table when it comes to government schools.  It is all about the POWER and the Money that comes with it.

This video from the National Education Association’s top lawyer, Bob Chanin, shows how surprisingly open the nation’s leftists are when they no longer have to pose for the cameras and get to speak to one another. Addressing the 2009 NEA Convention, Chanin admits, “It is not because we care about children and it is not because we have a vision of a great public school for every child. And a $500,000 per year Government School employees admits that when it comes to making a choice between people like him being able to continue to be paid this outrageous salary, the children are going to just loose.

New Jersey Education Association Executive Director Vincent Giordano appeared the “New Jersey Capitol Report” this weekend to discuss the costs of education. Giordano tells poor families who can’t afford to go to better schools “life’s not always fair.” Transcript below.

Host: The issue of fairness, I mean this is the argument that a lot of voucher supporters make. People who are well off have options. Somebody who is not well off and whose child is in a failing school, why shouldn’t those parents have the same options to get the kid out of the failing school and into one that works with the help of the state?

NJEA boss Vincent Giordano: Those parents should have exactly the same options and they do. We don’t say you can’t take your kid out of the public school. We would argue not and we would say ‘let’s work more closely and more harmoniously’ …

Host: They can’t afford to pay, you know that. Some of these parents can’t afford to take their child out of these schools.

Giordano: Life’s not always fair and I’m sorry about that.

There was a time, not too long ago, when being a citizen of one of the United States of America, and being in one of those states, would protect you from being snatched off the street and heard form no more, of being denied the ability to travel, of having your property or  your privacy violated or stolen with not so much as a nod to the IV and V amendments to the Constitution (that pesky document that renders all of these actions Unconstitutional and Illegal) all by the very organizations established by the States (The House, Senate, Executive and Judicial branches of government) with the sole purpose of protecting and defending your safety, your property and your other God Given Rights!  But it is not like that any longer.

With so called “Laws” now giving different paramilitary organizations (Special Militias that the founders warned us about) the ability to arrest you without a warrant, to search your personal property without a warrant,  break your door down and kill you, your wife and your children with NO fear of being held responsible for those actions, to steal your property with no recourse to the courts, we find ourselves in exactly the same position that Ray LaHood’s son, Sam, finds himself in while in Egypt.

“The workers, who include Sam LaHood, director of the International Republican Institute‘s Egypt program and son of Transportation Secretary Ray LaHood, work for democracy organizations that provide training on setting up political parties, civil rights groups and elections.

Egyptian police raided the offices of 10 foreign civil rights organizations last month, including three U.S. organizations: LaHood’s IRI, the National Democratic Institute and Freedom House. Police seized computers, files and cash. Judges then called workers in for questioning. (Notice, just like in the US, members of Special Militias can do the same things or even worse in some cases, write their own warrants – JWB)

“It’s bad enough a month ago there was a raid on our headquarters in the country, and then they had people brought in for questioning, and now there’s this no-fly list,” said Lorne Craner, president of the International Republican Institute. “Now imagine Americans being arrested and being put in a cage in a Cairo courtroom.” (No, not a cage in a courtroom, but a cage in a prison with NO access to family or lawyers.  This the only difference between the Egyptian system and ours – JWB)

LaHood was the first to learn he was barred from travel when he tried to leave Egypt on Saturday and an official took his passport and disappeared for an hour, Craner said. She “came back and said ‘You’re not flying today,’ ” and he was escorted out of the airport, Craner said.  (Sounds JUST like the US No Fly List.  You will NOT know you are on the list and will have no chance to get off the list until you get to the airport and are told, some faceless bureaucrat has decided YOU cannot Fly – JWB)

Craner said Egyptian authorities have accused the organizations of operating without a license, though he says IRI applied for one when it started operating there in 2006, but the license was never provided.  (Sounds like any number of agencies, like the EPA here.  They won’t say no, but won’t respond.  Then when you think it is ok to proceed, they come down you like a ton of bricks – JWB)

“We were never told we can’t do this kind of work and were encouraged informally including under (ousted President Hosni) Mubarak to continue,” Craner said.  (In the US, we just have so many laws that NO ONE can ever know if they are breaking any of them or not.  Over 4500 Federal laws alone and tens of thousands of State and Local Laws.  You, just like Mr. LaHood cannot know if you are breaking the law, these are just two different methods to keep you in the dark – JWB) the raids may be an attempt by the country’s military junta to show Egyptians “they are totally independent and not a puppet regime” of the United States, said Khairi Abaza a former official of the liberal Egyptian Wafd Party. (In the US, the EPA and FDA and FBI and ATF constantly remind US Citizens that they, the alphabet organizations are Totally independent and not restrained in any way by anything as pitiful as a Constitution – JWB)

The cases, even if they result in acquittals, “will act as a deterrent” for civil society in Egypt. (Like they do here.  Brutally Arresting people or shooting them or their dogs or family members and multiple laws that NO ONE can know t have a very ‘chilling effect’ on free speech or expression and most other activities – JWB)

Abaza says. Egyptian Cynthia Farahat of the Center for Security Policy says the attack on democracy groups is part of the military government’s decades-long campaign against liberalism in Egypt. (And we have had a campaign against our Constitution since 1861 – JWB)

Obama is fond of preaching that everyone must pay their fair share.  And those who work harder than others, must be made to pay even more taxes than the less productive and successful masses.  That is unless you are a member of Obama’s government.

In Obama’s executive branch alone, there are 36 ”Timmy Geithner” wanna bes that owe $833,970 in back taxes.

But it would seem that he is in good company.  It would seem that every one of our National Government Departments do not want to pay their “Fair Share”.

“President Obama went on and on Tuesday about how important it was for Americans to pay their “fair share of taxes.” He can start with his own administration. The number of employees on the federal dole has swelled 13 percent on his watch, and the amount they owe in back taxes is now over $1 billion. (emphasis added) Talk about double dipping: These bureaucrats take your tax dollars and then return nothing to the Internal Revenue Service (IRS).

The tax man is required to send Congress an annual report on the number of serious delinquents working in each government agency. Figures released this week show 98,291 current civilian employees have a severe tax lien against them. When retirees and military personnel are included, the debt figure goes up to an astounding $3.4 billion. Without some kind of accountability, the number will grow larger.

The ironies abound. The Office of Government Ethics has one of the highest delinquency rates at 6.5 percent. You might think the U.S. Tax Court would pay its taxes, but its staff owes Uncle Sam $62,508. The Government Accountability Office has 65 employees not being held accountable. The Board of Governors for the Federal Reserves has 91 staffers who have reserved $1,265,152 in their own pockets.

The National Labor Relations Board doesn’t seem to mind the 47 on staff who are laboring only for themselves. The Office of Personnel Management isn’t doing a very good job managing its personnel, who owe the IRS $1,917,149. The Securities and Exchange Commission may be policing Wall Street, but it’s turning a blind eye to $1,146,843 in back taxes.

Overall, the highest delinquency rates are found at the Advisory Council on Historic Preservation, the Institute of Museum and Library Services and, in a tie, the Inter-American Foundation and the United States Access Board. The highest amount owed the IRS – $269,641,265 – comes from the Postal Service (which also has the most cheaters – 25,640), Social Security Administration at $20,144,559 and the House of Representatives, with 467 cheating staffers owing $8,535,974. (emphasis added)

In the Senate, there are 217 who owe the IRS a total of $2,134,501. There are 36 scofflaws in the Executive Office of the President, owing a total of $833,970. (emphasis added)

Since 1993, the IRS has been able to fire any of its employees for failing to pay up. As a result, that agency has one of the lowest delinquency rates in the bureaucracy. Rep. Jason Chaffetz wants to extend that power, rewarding seriously delinquent civil servants with a pink slip. “We want compliance, and we want to get the money back,” the Utah Republican told The Washington Times.  (what do you think the chances of THIS actually happening…slim to none I would think – jwb)

Mr. Chaffetz said the only opposition to an expected floor vote is coming from public unions. “The only excuse I hear – and it makes me chuckle – is, ‘We want them to have their income so that they can pay their taxes.’ And my argument is, ‘But they’re not doing that now.’ “

With 8.5 percent unemployment, government jobs are more in demand than ever. “Working for the federal government is a privilege,” Mr. Chaffetz said. “A lot of people want these jobs who are good, decent, hardworking people.” No one who refuses to pay taxes should be allowed to stay in those cushy, overpaid federal positions.

He is correct of course in comparing himself with these three Nightmares.  And only if you consider the Murder of over 600,000 people, the end of our Federal Form of Government and making cronie capataism a permanent part of the National Government’s operations (Lincoln), and presiding over, and perpetuating, the largest depression in the history of These United States of America, and lying in order to get re-elected then breaking his promise and getting us into a terrible war (FDR) and the placement of an entire population, Blacks, into a second class status, destroying the Black Family and introducing dependency as a way of life to millions of people and escalating a war and implementing “rules of engagement” which ensured the loss of thousands of lives of our servicemen at the altar of Political Awareness (Johnson) as “Good Things” I guess he may be correct.

Obama has abandoned our allies in the Middle East.  Pulled our troops out of Iraq before that country was ready for any type of self government and has a foreign policy on par with Jimmy Carter.

Iraq has, in just a few weeks, turned back into a religious killing field with Shiites and Sunnis at each other’s throats once more.  And where our friend in Egypt (the enemy of my enemy is my friend) was disposed and religious murders and persecution implemented in his place.  And in Libya, where Kaddafi had rolled over and played an obiendent lap dog AND kept the radicals in that nation at bay, now has that radical Islamic movement once again terrorizing the people of that country.

And he lost one of our most technologically advanced weapons, a Drone, to a crazy man in Iran and did NOTHING to get it back.

And of course he has used his Connie Capitalism to reward campaign contributors (like all three he mentioned above) and has ruined the lives of millions and the economy of the Country.  Yeah, I think Obama, Lincoln, FDR and Johnson are the perfect four horsemen of the American Apocalypse and he fits in with these American Nightmares very well.

Obama has continued along the lines of some of the worst Presidents in the Short history of These United States.  In a little over 150 years, Since Lincoln’s War against Federalism and the South, we are NO LONGER a Federal Union, We have Standing Armies, destructive Taxes, a congress that has basically abrogated all of its responsibilities and powers to the Executive and Judicial Branches, have a permanent Under Class, a Federal Police Force with more corrupting powers than King George could have dreamed of and they have converted almost half of the People of these United States into Parasites.

Yes Obama, you may be a legend in your own mind, but you are really nothing more than one, in a long line of Nightmares, in our minds.

 Here is Another case where the JURY can “Correct” bad laws.

A woman from Tennessee made the huge mistake of thinking that just because a person wears a police uniform, that you can trust them. This is almost Never the case. Cops today are, by and large, just members of an overbearing class of thugs. Their primary Raison d’être is NOT to protect and serve but to Harass and Arrest regular citizens for make believe crimes.

  Meredith Graves, a 39 year old Medical Student from Tennessee obtained a Certificate from the State of Tennessee to carry a weapon concealed.   (This Certificate is recognized by all but 10 states and the District of Columbia. It’s interesting to note that all of the States that do NOT recognize these certificates are all Liberal Democrat controlled States.) She then took a trip to New York.  The first mistake was to carry the gun into any sort of government facility. The “Government, which was Established and Ordained to Protect your God Given, and Constitutionally protected Rights”, has suspended your 2nd amendment RIGHT to “Keep and Bear Arms”. Once she realized she was in a place where guns were unconstitutionally bared, (look the the signs of a gun with a red slash through it.  You will know that you are in a Constitution Free Zone when you see these) she should have quietly left and gone on the internet to see what she missed.

 The second mistake was trusting any cop, in today’s Police State world, to do the right thing.

 And Thirdly, and probably the worst mistake was to EVER travel to a place like New York of Washington DC where the Constitution has been suspended.

 Now think about this for a bit. In the Constitution which was “Ordained and established FOR (not Of) The United States of America” the second section of the IV article states: “The Citizens of each state shall be entitled to all Privileges and Immunities of Citizens in the several States”.

 Now this is the clause that requires that New York recognize a marriage certificate from Tennessee. While there is NO specified “Right” identified in the Constitution for Marriage each State is required by this clause to recognize all other State’s marriage certificates.

 And Drivers Licenses are not mentioned anywhere in the Constitution. But, New York, and every other state, by the same clause, is required to recognize each other State’s driver’s licenses.

 The reason for this is that no specific recognition for marriage or traveling was ever considered as something that needed specific protection when the Constitution was being drafted. Marriage and traveling were the “Norm” in all of the States of America.   These were Natural Rights of your Free Will and which were a gift from your Creator! And while the “Right to Keep and Bear Arms” was a given in the same time frame, this one was considered SO IMPORTANT to the safety of The People of the States that it was embedded into the Constitution as the Second Amendment.

 So, Tennessee has a system which  (I believe is extra constitutional but using the same reasoning for requiring a drivers or marraige certificate) protects its Citizens from the Government while they carry a weapon concealed. They have a “Certificate” of sorts, which establishes the State will NOT infringe on this right. This would be considered a Privilege or Immunity for that Citizen and is recognized under the above reference.

 New York, or any State or municipality which does NOT recognize the God Given Right of Every Person in the World to protect their life and property needs our attention. And NOT recognizing these State Issued certificates is plainly in violation of the Constitution FOR the United States of America and are Direct infringments upon Article IV, section two of the Constitution AND an infringment on Amendment II to that Constitution.

 This is where knowing YOUR RIGHTS and Power and Responsibility as a Citizen of any State under our Constitution as a juror become critical. You need to make sure your name is IN the pool of prospective Jurors. And if you are picked to be on a Jury, you need to know that the one LAW and the ONLY ONE LAW that you are required to find guilt or innocence under is the Constitution FOR the United States of America Period.

 Any so called Law or Regulation that is Not in harmony with the Constitution is no law at all (this would of course include EPA regulations that take someone’s property or restrict the use of that property.  Or of the Cops being able to kick your door down in the middle of the night and shoot your wife and/or children. Or telling you what you can and cannot do with your own body. And about 90% of all of the so called Laws and Regulations on the books today).

 Cases like this one is what I refer to as a “Finger Nail Cleaning Moment”. That the prosecution of Meredith Graves is SO far outside of the Law of the Constitution that if you are chosen to be on the Jury, you do NOT even have to listen to any of the Arguments. Mrs. Graves is NOT GUILTY as the secondary law that she is being prosecuted under has NO FORCE and is Null and VOID. Period. The Constitution ALWAYS trumps the small minded politician’s laws and regulations!  And it is YOUR Job as a Juror to make sure this is done.

The School called the cops and I believe it was Three of the Jack Booted thugs showed up and proceeded to kill Jamie.

Now they will claim, as they always do, that the told Jaime to put the gun down.  But then they shot him.  Not once, but Three times.  Who knows if he did or not.  He is dead.

This reminds me of the murder of one Amadou Diallo, who was UNARMED but still shot 41 times by Jack Booted Thugs in the Bronx, New York.  Or Deandre Brunston in Compton who was not armed but still shot 81 times.  Or Sean Bell of Queens who was hit with 50, Out of over 1000 shots fired at him. 

Of course ALL of these Jack Booted Thugs got off scot free.  Seems that if you are a sociopath and love killing people, become a cop where you can do it and have your superiors make excuses for you. 

“The city agreed Tuesday to pay more than $7 million to settle a wrongful death civil suit lodged by the fiancé and pals of Sean Bell, the unarmed black groom gunned down by cops on his wedding day, sources said.

The settlement, approved by a Brooklyn federal magistrate, ends a four-year legal battle by tragic would-be bride Nicole Paultre Bell and two men wounded in a 50-shot barrage that claimed her lover’s life.

I got a metal rod in my leg. I have four bullets still in me,” he said, standing in front of Brooklyn Federal Court with Paultre Bell and their lawyer Sanford Rubenstein. “I don’t think a black or Hispanic man’s life means much in this city. It will happen again.”

Guzman and Benefield, who is black, were in a car with Bell when undercover cops opened fire on them outside the Club Kalua strip club in Queens on Nov. 25, 2006, hours before Bell was to get married.

Detectives Michael Oliver, Marc Cooper and Gescard Isnora were all acquitted in a 2008 trial of manslaughter and reckless endangerment charges stemming from the Bell shooting. (they allway are.  there is NO justice when the Cop is the criminal - jwb)The cops fired on Bell’s lurching car after mistakenly believing someone inside had a gun and fearing that Bell was trying to run them down.

The U.S. Attorney in Brooklyn declined to prosecute the cops for civil rights violations. (you really have no civil rights when some cop decides to “off” you. – jwb)

So the Gonzales family will most likely find no justice in this matter.  Cops routinely kill people and shoot body parts off of children and their only criticism is, they waited too long to shoot.  It has become a nauseating chore just to report on all the innocent people that get killed in the drug war. But until our public servants stop killing us to protect us from drugs, the reporting must continue:

“Tarika Wilson, 26, was shot and her 1-year-old son was wounded when Lima police conducted a drug raid on their home Friday night, prompting members of the black community to organize a candlelight vigil and demand answers from police.

“They shot my daughter and her baby,” Ms. Jennings said through tears while being consoled by other family members. “The police have to pay for what they did. They went in that home shooting and killed her.”  (no, Ms. Jennings.  They will not pay.  These Jack Booted Thugs NEVER have to pay.  They just get to keep on murdering innocent people then lying to cover it up – jwb)  [Toledo Blade]

Tarika Wilson’s boyfriend was arrested for marijuana and crack, but police haven’t reported how much they found. Something tells me this is because the amount is very small. Too small to justify shooting a baby. Similarly, they haven’t said a word about why Ms. Wilson was shot. If they had a good answer, we’d know by now what it is.

Or how about a Marine who survived two tours in Iraq only to be murdered by, you guessed it, another SWAT team raid.  And this raid, like many others, was at the wrong house.  The young marine heard the noise of them breaking his door down and grabbed his weapon to investigate.  He is now dead too

“Please send me an ambulance and you can ask more questions later, please!”

Guerena tells the dispatcher that her husband had returned home about 6:30 a.m. after work and was sleeping.

Prompted by the dispatcher, Guerena says her husband was shot in the stomach and hands.

The dispatcher asks Guerena to put her cheek next to her husband’s nose and mouth to see if he’s breathing, but she replies in Spanish that her husband is face- down.

The operator tells Guerena to grab a cloth and apply pressure to his wounds, but the wife responds frantically: “I can’t! I can’t! There’s a bunch of people outside of my house. I don’t know what the heck is happening!”

A dispatcher asks if the people outside are the SWAT members. “I think it’s the SWAT, but they … Oh my God!” Guerena says.

A dispatcher asks that she open the door for the SWAT, but Guerena replies that the door was already opened by police.

“Is anybody coming? Is anybody coming?” she asks.

The operator tells Guerena help is on the way, but they’re still trying to figure out what happened.

“I don’t know, that’s it, whatever I told you, that’s it,” Guerena says.

Just after the five-minute mark, Guerena’s end of the line goes silent.

The two dispatchers spend about four minutes talking to each other and calling out for Guerena while trying to figure out if the call is coming from the same residence where the warrant was served. At the end of the 10-minute 911 call, a dispatcher says she has confirmation that Guerena is outside with deputies on the scene.  This is from Arizona Daily Star reporter Fernanda Echavarri’s effort to piece together the death of Jose Guerena, 26, at the hands of a Pima County, Arizona SWAT team. Guerena, who joined the Marines in 2002 and served two tours in Iraq, was killed just after 9  a.m. May 5. Guerera had just gone to bed after working a 12-hour shift at a local mine when his home was invaded as part of a multi-house crackdown by sheriff’s deputies.

Like enemy of the state Osama bin Laden, Guerena died with his wife close by. Widow Vanessa Guerena, who hid with her four-year-old son when sheriff’s deputies raided the home, fills in detail that has been slow to come from Pima County Sheriff Clarence W. Dupnik’s office: 

 ”When I came out the officers dragged me through the kitchen and took me outside, and that’s when I saw him laying there gasping for air,” Vanessa Guerena said. “I kept begging the officers to call an ambulance that maybe he could make it and that my baby was still inside.”  (Cops just don’t care.  In Fort Smith Arkansas a similar thing happened to a man who was sitting at his dining room table and a threat to no one when a low life cop, kicked his front door open and shot him.  As the man lay on the floor bleeding out, all this worthless piece of crap cop could say was, “let me see your hands”. He then proceeded to handcuff him and let him lay there.  Made NO attempt to stop the bleeding of save this man’s life.  This man also died due to absolute lack of any care or concern on this Jack Booted Thug’s Part – JWB)

The little boy soon after walked out of the closet on his own. SWAT members took him outside to be with his mother.

“I never imagined I would lose him like that, he was badly injured but I never thought he could be killed by police after he served his country,” (no one is safe from these Jack Booted Thugs Vanessa.  And what is sad is that many of these creeps are former members of different branches of the Armed Services.  They have no compunction to killing Anyone – jwb)  Vanessa Guerena said.

The family’s 5-year-old son was at school that morning and deputies say they thought Guerena’s wife and his other child would also be gone when they entered the home.

Guerena says there were no drugs in their house.

Deputies said they seized (euphemism for STOLE – jwb) a “large sum of money from another house” that morning. But they refused to say from which of the homes searched that morning they found narcotics, drug ledgers or drug paraphernalia. Court documents showing what was being sought and was found have not been made public. A computer check on Guerena revealed a couple of traffic tickets and no criminal history.

Tucson KGUN’s Joel Waldman says the SWAT team prevented paramedics from going to work on Guerena for one hour and fourteen minutes. (this is not uncommon for these thugs.  They know a dead victim is safer for them than one who is alive and can dispute their fabrications of what really went down – jwb)

The sheriff’s department maintains that Guerena was holding an AR-15 when the paramilitary force fired 71 bullets in his home, but other key parts of the government story have collapsed. While PCSD initially claimed Guerena fired the weapon he was alleged to have been holding, the department now says it was a misfire by one of the deputies that caused this deadly group panic inside a home containing a woman and a toddler: 

A deputy’s bullet struck the side of the doorway, causing chips of wood to fall on his shield. That prompted some members of the team to think the deputy had been shot, PCSD spokesman Michael] O’Connor said. Guerena was a Tucson native and Flowing Wells High School graduate. He joined the U.S. Marines in 2002. He served two tours in Iraq in 2003 and 2005 as part of the Yuma-based MWSS-173 under direct supervision of Master Sgt. Leo Verdugo.

Verdugo was with Guerena’s family Tuesday afternoon. He gave them a Marine Corps jacket and gloves to use at Guerena’s burial.

“He was an excellent Marine, with a bright future ahead of him,” Verdugo said.

“We had just bought a home and he was working graveyard shifts and overtime just to help pay the bills, we were just starting to make this house our home,” Vanessa Guerena said.

“I know I can’t have him back but I want justice. I want explanations for what happened,” she said.  (what happened Vanessa is that a bunch of hyped up Jack Booted Thugs were out for some fun.  They knew that they were free to do whatever they wanted to do and no matter what happened, their bosses, mayors, police chiefs, city attorneys, etc, would have their backs.  You poor husband was just one more victim to the madness called “the war on drugs”.  And sadly, he will NOT be the last. Now let’s look at what just happened in Utah. 

(CNN) — Utah law enforcement officers mourned the loss of one of their own (While America mourns another Unconstitutional no-knock raid – jwb) Thursday after an Ogden, Utah, officer was killed and five other officers shot while serving a search warrant.

All six were rushed to hospitals after the shooting, Ogden Assistant Police Chief Marcy Korgenski said. The suspect in the case also was wounded and taken to a hospital.

Ogden city officer Jared Francom died from his wounds, Ogden police said early Thursday.

“Agent Francom has served the citizens of Ogden city with honor for seven years,” authorities said in a statement Thursday. “He is survived by his wife and two young children.”

The suspect, identified Thursday as Matthew David Stewart, 37, suffered injuries not considered life-threatening but was also hospitalized.

The injured officers were identified as Sgt. Nate Hutchinson with the Weber County Sheriff’s Office; and Jason Vanderwarf, Shawn Grogan, Kasey Burrell and Michael Rounkles. CNN affiliate KSL said Vanderwarf is with the Roy, Utah, police and Grogan, Burrell and Rounkles are Ogden officers.

Ogden Regional Medical Center said Thursday that Vanderwarf was treated and released.

The remaining four officers remained in Ogden’s McKay-Dee Hospital, spokesman Chris Dallin said. Three were in critical condition, with one in stable condition, he said.

At a Thursday news conference, several officials fought tears as they discussed the incident.

“This is a family. This is a law enforcement family,” Ogden Police Chief Wayne Tarwater said. “The law enforcement community is mourning.”  (and America is in morning for all of the innocents that cops, like these, kill or maim or imprison unjustly every day – jwb)

“We have lost a brother,” Weber County Sheriff Terry Thompson said. “We will grieve this loss” with the knowledge that Francom gave his life for his fellow officers and the community, he said. (no, he did not.  He took part in an unconstitutional home invasion and got his ass handed to him. Grieve for his family, but not for him or anyone like him – jwb)

The officers, who were part of a multiagency narcotics task force, were attempting to serve a search warrant at an Ogden address Wednesday night, according to the statement.

The warrant was “based on probable cause there was drug activity (Or maybe there was some Money to be had – jwb) in that location,” Tarwater said, but would not elaborate.

The warrant was a “knock-and-announce” warrant, meaning that officers knock on a residence’s door and announce their presence, he said. If no one answers, “under certain circumstances, they will go ahead and enter the home. That’s exactly what happened.“  (in other words, a No Knock Raid.  What would YOU do if, in the middle of the night, you heard your door come crashing down and a bunch of loud thugs come rushing in?  I know what I would do – jwb)

When they entered the home, the officers came under fire, he said. 

The task force requires officers to wear bulletproof vests, he said, and “as far as I know, the officers were wearing vests and protective gear.”  (of course the victims of these no-knock raids do NOT have the benefit of ‘suiting up’ before the action goes down no, most of the time the are asleep, totally surprised and disoriented and operate on reflex as much as anything else.  And all too often they are killed due to not being prepared – jwb)

Officers were proceeding with the search warrant execution at 8 a.m. Thursday, he said, a process that will take hours.

Stewart has a “limited criminal history,” Tarwater said. He did not have specifics but said he believed Stewart’s record was mostly misdemeanors.

Asked about reports that as many as 12 officers were sent to the home, strike force commander Lt. Darin Parke told reporters that number is not unusual. There was “not really a great deal that set this investigation apart … other than the outcome,” he said. (yes, THIS time the Jack Booted Thugs got THEIR hat handed to them! – jwb)

The shooting will be subject to an internal investigation as well as an external review by the Weber County attorney, he said. (let me guess what the outcome of This will be. Jwb) Citing those investigations, police limited the release of information.

Tarwater thanked the state of Utah, particularly police agencies, for their support. He said that at one point, at an Ogden hospital Wednesday night, there were “40 officers from probably seven different agencies.”  (I wonder how many “officers” went to check on Jose Guerena in Arizona.  You know, the ex-marine who was murdered in his own home by these Jack Booted Thugs – jwb)

Utah Gov. Gary Herbert has ordered that state and U.S. flags be lowered in the city of Ogden to honor the officers, Ogden Mayor Mike Caldwell said. Thursday was Caldwell’s first day on the job.  (why do we show homage or respect to people like this.  He broke the law by breaking into a man’s house.  That man acted to protect his property. its that 4th amendment thing.  He had NOT had due process of law, just a bunch of lawless thugs who thought they would get away with it one more time – jwb)

…The shootings follow a year in which U.S. cities saw an increase in officers killed. The number of officers who died in the line of duty in 2011 increased 16% nationwide from last year, according to the National Law Enforcement Officers Memorial Fund. (I wonder if there is a National Victim of Law Enforcement Officers Memorial Fund.  If so, there would be a lot more than 177 of them listed- jwb)

Now I am totally against ANYONE Killing ANYONE else except in defense of self, property or loved ones, PERIOD.  But of all of the stories above, I believe the only justified shooting was by Matthew David Stewart who took action to defend himself from one of the many No-Knock raids performed by Jack Booted Thugs all over These United States.

It was one year ago this week that narcotics officers in Atlanta, Georgia broke into the home of 92-year-old Kathryn Johnston.

They had earlier arrested a man with a long rap sheet on drug charges. That man told the police officers that they’d find a large stash of cocaine in Johnston’s home. (These Jack Booted Thugs had their guns and they were not afraid to use them – jwb)When police forced their way into Johnston’s home, she met them holding a rusty old revolver, fearing she was about to be robbed. The police opened fire, and killed her.

Shortly after the shooting, the police alleged that they had paid an informant to buy drugs from Ms. Johnston’s home. They said she fired at them first, and wounded two officers. And they alleged they found marijuana in her home.  (All Lies, which is what this War on Drugs has turned man in our Police Departments into.  Bold Faced LIARS – jwb)

We now know that these were all lies. In fact, everything about the Kathryn Johnston murder was corrupt. The initial arrest of the ex-con came via trumped-up charges. The police then invented an informant for the search warrant, and lied about overseeing a drug buy from Johnston’s home.

Ms. Johnston didn’t actually wound any of the officers. They were wounded by fragments of ricochet from their own storm of bullets. And there was no marijuana. Once they realized their mistake, the officers handcuffed Ms. Johnston and left her to bleed and die on the floor of her own home while they planted marijuana in her basement.

We now know that it was routine for Atlanta’s narcotics officers to lie on drug warrants. We know that judges in the city rather systematically approved those warrants with no scrutiny at all (the judge in the Johnston case literally rubber-stamped the warrant), abrogating their oaths as guardians of the Fourth Amendment.

Two months before the Johnston raid police officers nearly killed another elderly woman in the same neighborhood after forcing their way into her home in a mistaken raid. A year earlier, they had mistakenly raided the home next door to Johnston’s. And just days before, Atlanta police had conducted another forced-entry raid that turned up all of two marijuana cigarettes.

We now know that once the officers in the Johnston case knew they were in trouble, they pressured one of their actual drug informants to lie for them, and vouch for the fabricated account of the controlled buy.

That informant–Alex White–refused, and bravely came forward to tell the media what had happened. Had he given in to the pressure put on him by APD narcotics officers, the world would still likely believe Kathryn Johnston was a drug dealer, and her killing was justified.

In fact, subsequent investigations showed that the corruption at the Atlanta Police Department was so pervasive, Police Chief Richard Pennington eventually had to replace the entire narcotics division. (replace with what?  Did he magically find some mortal men who will NOT succumb to the temptation provided by Power and Money to become just as corrupt as the ones they replaced? Jwb)

Atlanta is still in a state of self-examination since the Kathryn Johnston case. To its credit, the city is considering real reform in the way it conducts its drug policing. Politicians at the municipal, state and federal level may guide that process, as may a lawsuit from Ms. Johnston’s family.

But beyond Atlanta, the beat goes on. All across the country, narcotics units and SWAT teams are still kicking down doors in the middle of the night and still deploying flash grenades and using aggressive, paramilitary tactics–and they’re still doing all of this to apprehend people suspected of nonviolent crimes. And they’re still making mistakes.

In February of this year, 16-year-old Daniel Castillo, Jr. was killed in a police raid on his family’s home in Texas. Castillo had no criminal record. A SWAT officer broke open the door to the bedroom as Castillo, his sister, and her infant son were sleeping. When Castillo rose from the bed after being awoken to his sister’s screams, the SWAT officer shot him in the face.

In March, police in Spring Lake, Minn., acting on an informant’s tip, raided the home of Brad and Nicole Thompson. The couple was forced on the ground at gun point and warned by an officer, “If you move, I’ll shoot you in the f___ing head.” Police had the wrong house.  http://reason.com/archives/2007/11/23/kathryn-johnston-a-year-later

Context for Kathryn Johnston

When people like Kathryn Johnston or Cory Maye understandably mistake raiding police officers for criminal intruders, police and prosecutors are rather unforgiving, particularly if the warrant was “legal.” People like Maye and Johnston are supposed to show remarkable poise and judgment, despite the fact that armed men are breaking into their homes.  (Think Jury here folks.  A jury finding in the Millions of Dollars against these people is the only way this will ever stop.  These will be civil trials since the acts of these Jack Booted Thugs are always excused by the people who are charged with keeping the law – jwb)

When police make mistakes, however, they’re nearly always forgiven. Because we’re supposed to understand how an officer in such a volatile situation might misjudge an everyday object for a gun, or shoot a completely innocent, unarmed man — all perfectly understandable, given the volatile, confrontational circumstances surrounding SWAT raids. Such deaths — while tragic — are mere collateral damage. We have to keep fighting the war on drugs. And we have to protect our police officers by allowing them to break down doors while people are sleeping. The deaths of a few innocent people are the price we pay for the privilege of having the government tell us what we are and aren’t allowed to put into our bodies. (Think about this folks – jwb)

It’s an abhorrent double standard. Below, I’ve listed some cases that illustrate it. The cases below tend to be below-the-radar cases. (most of these cases are like these and get NO National attention.  But let One Jack Booted thug get his comeuppance, and watch the it be all over the news – jwb)

The list doesn’t include higher-profile deaths like those of Clayton Helriggle, Mario Paz, Alberto Sepulveda, or Donald Scott, among others, because most people who’ve been reading this site for a while already know about them (if you’re interested, I’d encourage you to Google those names).

Here, a brief list of cases to put the Ms. Johnston’s death into its proper context. Let’s start in Georgia:

  Xavier Bennett: In 1991, police in Dekalb County conduct a 2:30am no-knock raid on the home of Bobby Bowman, a man they suspect of possessing cocaine. They were right. He did, though only enough to identify him as a user, not a dealer. What they didn’t expect is that his 8-year-old stepson Xavier Bennett would be inside, too. When Bowman, who says he thought he was being invaded, met police with a gun, the boy was killed in the crossfire. No disciplinary actions were taken against the police. (like I said, if you are a sociopath and just LOVE power and being able to kill with NO repercussions, be a cop – jwb)

So police conduct a dangerous no-knock on a home where a child’s inside. The child dies. Police blame the father of the child for (1) possessing cocaine, and (2) not realizing the raiding party was police.

  Lynette Gayle Jackson: On September 22, 2000, police in Riverdale, Georgia shoot and kill Lynette Gayle Jackson in an early morning, no-knock drug raid.

Less than a month earlier, Jackson had been at home when burglars broke into the same house. She escaped out a window and called the police while the intruders ransacked her home. When police arrived to answer the burglary call, they found a small bag of cocaine in the bedroom that belonged to Jackson’s boyfriend. While the quantity of cocaine wasn’t sufficient to press charges, police began a subsequent investigation of Jackson’s boyfriend that led to the September no-knock raid on her home.

As that raid transpired, Jackson, believing she was being robbed again, held a gun in her bedroom as the SWAT team entered. That’s when the police opened fire, killing her. Her maintenance man later told reporters she had been frightened by the previous burglary. Jackson had asked him to install new locks, security bars on her windows, and a motion-detecting security light. The man told the Atlanta Journal and Constitution, “I think she was scared and she probably thought it was another break-in.”

No disciplinary action was taken against the officers.(ditto – jwb)

So police raid the home of an innocent woman while looking for her boyfriend. She mistakes them for intruders (justifiably so, after having just been burgled), and is shot and killed. It’s all her fault. Shouldn’t have been dating a man who uses cocaine. Shouldn’t have had a gun for home protection. Shouldn’t have been scared. Shouldn’t have assumed that when armed men break into your home, it’s probably the burglars who broke in last time, not police looking for your small-time, dope-using boyfriend.

  Roy and Belinda Baker. Early in the morning on September 30, 2005, police in Stockbridge, Georgia conduct a no-knock raid on the home of Roy and Belinda Baker. Officers break down the couple’s front door with a battering ram and toss in flashbang grenades. They hold the couple at gunpoint, handcuff them, and then send them out onto their porch, only partially clothed. Police ruin a family Bible and antique coffee table during the raid.

Police eventually realize the intended target of the raid lives next door. Police Chief Russ Abernathy called the raid “inexcusable” and “not acceptable,” and blamed poor street lighting. But Abernathy added that no one would be fired of disciplined, and that the raids would go on, albeit after “reviewing procedures.” The Bakers are considering a lawsuit.

So police conduct a raid on the wrong home. Had Roy or Belinda Baker owned a gun, one or both might be dead. But since no one was hurt, no harm was done, and it’s really no one’s fault. So there’s no need to assign blame. No one is punished for terrorizing two innocent people.

  Deputy Joseph Whitehead. In 2006, police in Macon conduct a 1:30 am raid on a suspected drug house. Residents of the house say they were startled from sleep, believed they were being robbed, and shot to defend themselves. In the process, the shoot and kill Dep. Whitehead. Once the resident realize they’re being raided by police and not gang members, they surrender immediately. Prosecutors charge all five residents with murder, including two who had nothing to do with the shooting, one who wasn’t even home at the time of the raid. Two face the death penalty. The sheriff later says of the raid, “It just went wrong.”

So if you mistake midnight-raiding police for intruders and there are drugs in your home, your mistake means the death penalty. If your roommates possess drugs and mistake raiding police for intruders and shoot and kill an officer, you’re looking at a murder charge.  (but if you are a Jack Booted Thug, you will face NO charges what so ever.  Might even get a citation for been cool – jwb)

Let’s leave Georgia, and look at some other cases:

  Charles Irwin Potts. On September 4, 1998, police in Charlotte, North Carolina deploy a flashbang grenade and carry out a no-knock warrant for cocaine distribution on a tip from an informant. By the end of the raid, police have put four bullets in 56-year-old Charles Irwin Potts, killing him.

Potts was not the target of the raid. He had visited the house to play a game of cards with friends. Police say Potts drew his gun (which he carried legally) and pointed it at them when they broke into the home. The three men in the house who saw the raid disagree, and say the gun never left Potts’ holster. (based on ALL of the DATA, I would put my money on the Three men in the house for telling the truth.  The Jack Booted Thugs who participate in these raids are horrible individual and lying to them is just a “police tactic” – jwb) Police found no cocaine, and made no arrests as a result of the raid. The men inside the house at the time of the raid thought they were being invaded by criminals. “Only thing I heard was a big boom,” said Robert Junior Hardin, the original target of the raid. “The lights went off and then they came back on . . . everybody reacted. We thought the house was being robbed.”

No disciplinary action was taken against the police for Potts’ death. So if you’re a completely innocent man in someone else’s home who mistakes invading police for intruders (assuming the police account is correct, not the account of the men inside) and draw your gun in self-defense, the punishment for your mistake is death. And the police, who are raiding to enforce a consensual crime, are right to shoot you.

Cheryl Lynn Noel. In January 2005, police in Baltimore conduct an early-morning, no-knock raid on the the Noel home after finding marijuana seeds and traces of cocaine in the family trash. Noel, who’s step-daughter had been murdered years earlier, retrieves a legally registered handgun when she hears the sound of home invaders rushing up her steps. A SWAT officer kicks open her door, and Noel, in her nightgown, is clutching the gun, not pointed, when he enters. The SWAT officer, wearing a bulletproof vest and helmet, and carrying a bulletproof ballistics shield, hits Noel twice from the doorway, then shoots her a third time from point-blank range. She dies. (big brave Jack Booted Thug.  What a hero.  A normal person could not live with themselves if they did something like this.  But these guys will get together after work and relive the whole thing while drinking beer and eating pizza – jwb)

Noel had no criminal record (her husband did, but his offense took place 35 years ago). She conducted Bible-study classes on her lunch breaks. Twenty months after the raid, and probably not coincidentally just weeks after the Noel family filed a civil rights suit, the Baltimore County Police Department awarded the officer who shot and killed Noel a medal for “bravery, courage, and valor” in shooting her.  So if you’re a woman whose daughter has been murdered, and you mistake raiding police for criminal intruders, your punishment is death, and the officer who shoots you not only isn’t disciplined, he’s given an award.

  Tony Martinez. On December 20, 2001, police in Travis County, Texas storm a mobile home on a no-knock drug warrant. Nineteen-year-old Tony Martinez, nephew of the man named in the warrant, is asleep on the couch at the time of the raid. Martinez was never suspected of any crime. When Martinez rises from the couch as police break into the home, deputy Derek Hill shoots Martinez in the chest, killing him. Martinez is unarmed.

A grand jury later declines to indict Hill in the shooting, and he continues his employment wit the police department. The same Travis County paramilitary unit would later erroneously raid a woman’s home after mistaking ragweed for marijuana plants. (this jury shoul be ashamed. But if you really knew how jurors are selected, and what they are told (lied to about) they must do, it is almost understandable – jwb)

So if police conduct a no-knock raid and mistakenly kill a completely innocent, unarmed person, it’s no one’s fault, because these raids are naturally dangerous and volatile, and it’s easy to see how mistaken identity might happen.

  Edwin Delamora. On February 15, 2001, the same task force that would later mistakenly shoot and kill Tony Martinez raids the Del Valle, Texas mobile home of Edwin Delamora, who lives with his wife and two children. As two deputies beat down his door with a battering ram, Delamora fires through the door, fearing he is under attack. His wife is on the phone with 911 at the time he fires. One bullet from his gun strikes and kills sheriff’s deputy Keith Ruiz.

Delamora had no previous criminal record, and his defense says the raid on his home was influenced by an anonymous informant who turned out to be the brother of two sheriff’s deputies. Information about the informant’s relationship with the police was suppressed at trial. (I hope no one is surprised about this.  This is the way the so called “Justice Departments” work in this country.  Cops kill and get away with it routinely.  You or I do ANYTHING wrong and we Will get prosecuted – jwb)

Delamora was eventually convicted of capital murder, and sentenced to life in prison. Police found less than an ounce of methamphetamine and one ounce of marijuana in his home. Prosecutors declined to seek the death penalty because of substantial doubt about whether or not Delamora knew the people outside his door were police. That decision sparked heavy criticism from Texas Attorney General John Cornyn (now a U.S. Senator), who moved for a law requiring the death penalty to be an option in any capital murder case. (This is what Prosecutors and Attorneys General do.  They ARE political animals and they will do anything, including putting innocent people in jail to advance their careers. – jwb)

Time magazine would later report that people in the community were suspicious of the narcotics task force, describing the team’s general attitude as “those task-force guys were Rambo wannabes.”

So if men are attempting to break into your home, and you mistake them for criminal intruders — bolstered by the fact that your wife calls 911 — you get no deference for the volatility or confrontational nature of SWAT raids. Mistake a cop for an intruder when firing your gun, and you’re going to jail for a long, long time. And God help you if there’s some dope in your house, too. When a member of the same SWAT team later mistakes and unarmed, innocent man for a deadly threat, and consequently shoots and kills him, the police officer won’t even be disciplined, much less sent to jail.

  Jose Colon: On April 19, 2002, police prepare to conduct a heavily-armed late-night drug raid (it includes a helicopter) on a home in Bellport, New York. As four paramilitary unit officers rush across the front lawn, 19 year-old Jose Colon emerges from the targeted house.

According to the police account of the raid, as officers approach, one of them trips over a tree root, then falls forward, into the lead officer, causing his gun to accidentally discharge three times. One of the three bullets hits Colon in the side of the head, killing him. (if you saw the musical Chicago, you remember the “Cell Block Tango” song, he had it coming.  And how one of those who “Had it coming” ran into her Knife 10 times!  This ‘accidental discharge three times’ is about as believable – jwb)

Colon was never suspected of buying or selling drugs, and had no criminal record. Police proceede with the raid, and seized eight ounces of marijuana. A subsequent investigation finds no wrongdoing on the part of police. (they are NEVER punished for what they do jwb) Colon was months away from becoming the first member of his family to earn a bachelor’s degree.

So, again, if a completely innocent person is killed in one of these raids due to police error, we’re supposed to be forgiving and understanding. Sometimes bad things happen with guns, I guess.

  Meredith “Buddy” Sutherland. On October 4, 2002, police raid a home in Windsor, Pennsylvania on suspicion of drug activity. Once inside, police go from room to room in the dark home. Trooper Gregory Broaddus enters a bedroom where Meredith “Buddy” Sutherland, Jr. is sleeping. Sutherland doesn’t live in the house, but is visiting a friend. Officer Broaddus mistakenly believes Sutherland to be clutching a weapon when he enters the room, and fires, striking Sutherland. Sutherland has no weapon, and would never be charged with a crime. He spent 11 days in a coma, and nearly three weeks in the hospital.

Other occupants of the home were eventually charged with drug crimes. Sutherland sued in June 2004 for redress for his injuries. The state attorney general in turn asked that the suit be dismissed, arguing that the officer in question had qualified immunity, and that, incredulously, Sutherland himself was responsible for his own injuries.

So if you are an innocent person visiting a friend whose roommates are involved in drug activity, if a police officer mistakes something you’re holding as you’re lying in your bed for a gun, it’s your fault for, I guess, lying there so guilty-looking, and your punishment is eleven days in a coma.

  James Hoskins. In February 2004, Middletown, Pennsylvania police storm the home of James Hoskins on a drug warrant. They are looking for Hoskins’ brother Jim, whom they eventually arrest for possessing “a small amount of marijuana, a glass pipe, and about $622,” according to the Philadelphia Inquirer.

From his bed, Hoskins hears the loud thud of police breaking into his home. Naked and unarmed, he gets up to investigate. As he approaches the door, a Middletown detective pushes his way into Hoskins’ bedroom. Hoskins and his girlfriend say the detective never identified himself. The detective fires, and later explains that he mistook the t-shirt Hoskins was using to cover his genitals for a gun. The bullet enters Hoskins’ abdomen, and rips through his stomach, small intestine, and colon. It eventually lodges in his leg, which must later be amputated.

It isn’t until weeks later, after he emerges from a coma, that Hoskins learns the man who shot him is a police officer, and not a criminal intruder. Remarkably, the Middletown Township police department saw no need to conduct an internal investigation of the shooting until prodded by the district attorney. The officer who shot Hoskins would never be disciplined.

So if a police officer mistakes a t-shirt for a gun and shoots an innocent man, we should give him the benefit of the doubt, given the volatile and confrontational nature of SWAT raids.

  Edward Benavides. In November 1993, police in Houston, Texas conduct a pre-dawn no-knock raid on the home of 21-year-old Edward John Benavides. As Officer Leslie I. Early enters the room where Benavides is sleeping, Benavides awakes, grabs his gun, points it at the door, and fires. Early is struck and killed. Upon realizing the raiders are police, Benavides immediately surrenders himself.

A subsequent investigative report by the Houston Chronicle found significant problems with the police investigation and execution of the raid, not least of which was the fact that Benavides didn’t know it was police officers who were invading his home until after he’d fired. One officer told the paper, “I think the Task Force may have had more to do with getting [Officer Early] killed than the kid [Benavides] did.” Police would not tell the paper the identity of the informant whose tip led to the raid, nor would they say whether or how much the informant was paid. Police found some weapons and $290,000 in cash in Benavides’ home (it’s not uncommon for immigrants to carry large amounts of cash), but no drugs.

In 1994, a jury convicted Benavides of murder, and sentenced him to life in prison. He wasn’t convicted of capital murder and was spared the death penalty because, according to the Houston Chronicle, “jurors had some doubt he knew pre-dawn raiders were police.” (again, Shame on this jury.  A jury that does not understand the role of the jury.  You need to attend a class on the Power of the Jury.  Understand its true role is NOT to convict people but to Protect people from things like bad laws and lawless cops.  Visit www.okfortea.com and Sign up for a course – jwb)

So if you mistake police for criminal intruders, and a jury actually concludes that you probably didn’t know the men breaking down your door were police, and you consequently shoot and kill one of them, you can still go to prison for life. Because you should have known better. You don’t get the benefit that comes with the volatility and confrontational nature of these raids, because you aren’t a police officer.
